We are not willing to allow our clients to put their home and lives on the line and risk losing their home.  Debt consolidation and credit counseling firms cannot provide you with the same help and protection that we can through Chapter 13.  For example, if you go to a credit counseling program they will tell you what you HAVE to pay, whereas in Chapter 13 you tell THEM what you can AFFORD to pay and you do not need to seek the approval of the creditors to do this.  You can also include ALL debt including medical, payday loans, court fines, student loans, tax debt and other government debts which other options cannot help you with. 

 

We know that bankruptcy is something that you are not approaching lightly and that you have investigated many options, done research, and may have even consulted other attorneys.  Perhaps you may have believed from this research that Chapter 7 is your best option but the fact is: it is not.  In fact, these other attorneys, credit counselors or debt settlement organizations probably did not even ask to see your home loan documents to review them before advising you, did not do a title search, or review your closing documents or research current litigation against your mortgage lender.  Due to all the pitfalls which can cost you your home we believe that Chapter 13 is your best option.  It is better than credit counseling, debt settlement or Chapter 7.  We want you to sleep at night knowing your home is safe and we want to help you avoid creditor liens, unwarranted and excessive mortgage fees and legal costs, and foreclosure.
